California’s Lemon Law Provides Strong Protections for Consumers

The Lemon Law protects car buyers and lessees from warranty defects that a car manufacturer and dealer cannot fix in a reasonable amount of time. We have all had a bad experience buying a car. But California Law provides very specific protections. It is time to fight back!

We Fight Exclusively for You

Unlike other law firms, we solely represent California consumers. We love representing people who can’t seem to get the help they need from car dealers and manufacturers. Taking on the Big 3 car manufacturers is not a cake walk. This is why we have chosen to focus on helping those who need the help most.

And don’t worry about attorney’s fees. When we win your Lemon Law Lawsuit, we will force the car dealer and manufacturer to pay for your legal fees. In other words, we don’t require you to pay us any up fees or costs whatsoever.

What Items are Covered Under the Lemon Law?

You might be surprised! Almost anything that is covered under the new car warranty, including:

  • Motor defects
  • Jerky transmissions
  • Leaking oil
  • Bad shocks or brakes
  • Electronics that will not work
  • Trunk releases
  • Defective paint or trim
  • Air conditioning
  • Batteries
  • Safety equipment
  • Airbags
  • Etc.

A brief history of the Lemon Law

California’s consumer warranty law, also known as Song-Beverly, requires that manufacturers of new motor vehicles leased or sold in California with a manufacturer’s written warranty repair the vehicle during the warranty period. If the manufacturer cannot honor the terms of the warranty by repairing the vehicle within a “reasonable” amount of time, the manufacturer most pay compensation to the owner.

In other words, people that purchase vehicles with manufacturer warranties do not need to put up with a broken car.

We represent consumers that need to enforce their rights under Song-Beverly. We aggressively pursue car manufacturer and dealers when they cannot honor their warranty commitments.

If you think that your car qualifies as a lemon, call us today. We will quickly and efficiently tell you whether you have a case. If you want to pursue your case, we will take the rest from there.

Lemon Law in 3 Easy Steps

  1. The Lemon Law applies to any vehicle that is within the new vehicle warranty. This includes the original purchaser of the new vehicle along with anyone that follows. In other words, the Lemon Law applies to used car purchases as long as car is still within warranty!
  2. The manufacturer or dealer cannot fix the car within a “reasonable” number of repair attempts. What is a “reasonable” number? That’s a something that we can help you with. It could be as little as one-to-two attempts.
  3. If the defect cannot be fixed, the manufacturer must replace the vehicle or reimburse the buyer for its purchase price. The choice is actually up to you, the consumer!

Frequently Asked Questions

Does the Lemon Law apply to leased cars?

Yes! As long as the vehicle comes with a new car warranty, the Lemon Law applies to purchased, financed, or leased vehicles.

Do I have to have purchased the car in California?

Yes, to qualify for relief under the Lemon Law, your car must have been purchased new in the State of California.

Does the Lemon Law apply to used cars?

Yes! As long as you are still within the new vehicle warranty period, you may qualify for help under the Lemon Law.

How long does a Lemon Law lawsuit take to finish?

A typical Lemon Law lawsuit in Sacramento will take around six months from start to finish. We fight hard for our clients to make sure that they get all of the benefits to which they are entitled under the Song-Beverly act. You cannot rush a good lawsuit.

The manufacturer is offering me arbitration. Is that a good idea?

Well, it depends. Manufacturers have set up industry-sponsored arbitrations to help deal with a flood of Lemon Law claims. Some consumers prefer to hire advocates who will fight for them in court. But that decision is up to you.

How do I file a Lemon Law claim?

Call us! We love representing consumers that need help with their broken cars. As car enthusiasts, we know a ton of about cars and how the car industry works. Let us guide you through complex litigation to get you help you deserve.

What about a car dealer that sold me a busted car? Can I sue them too?

We sometimes elect to file lawsuits against car dealers in addition to the original manufacturer. This decision depends on specific circumstances. Contact us and we can evaluate your case against a car dealer.

What type of defects apply?

You might be surprised! California law says that defect eligible for relief under the Lemon Law “substantially impair the use, value or safety” of the vehicle. This is a wide-ranging definition. In fact, there isn’t a specific list of defects that qualify. Don’t guess! Contact us and we can quickly evaluate your case.

What type of car defects do not apply for the Lemon Law?

We evaluate each car defect on a case-by-case basis. But generally, smaller issues that do not affect the use, value or safety of a car will not qualify. Think of minor squeaks or rattles, very minor paint defects, etc.

My car has been in the shop for more than 30 days. Do I qualify for the Lemon Law?

It sure sounds like it! Vehicles that are in the shop for 30 or more days in a one year period will have a very strong Lemon Law case. Contact us so that we can discuss the specifics of your situation.

I don’t have money to hire a Lemon Law attorney. How can I get help?

Don’t worry about attorneys fees. We love taking strong cases and will work hard for you without asking for any compensation up front. All of our Lemon Law work is taken on “contingency” which means we do not earn any compensation until we recover money for you.

I have had to spend a ton of money on repairs, towing, and rentals. Can I get reimbursed?

Yes! In most cases, a Lemon Law claim will include claims for “incidental damages.” These are things like towing, rental, and out-of-pocket repair fees reasonably incurred by the consumer. The idea of the Lemon Law is to make consumers whole. We will help you identify whether you qualify for any of these reimbursements.
