A brief history of the Lemon Law

California’s consumer warranty law, also known as Song-Beverly, requires that manufacturers of new motor vehicles leased or sold in California with a manufacturer’s written warranty repair the vehicle during the warranty period. If the manufacturer cannot honor the terms of the warranty by repairing the vehicle within a “reasonable” amount of time, the manufacturer most pay compensation to the owner.

In other words, people that purchase vehicles with manufacturer warranties do not need to put up with a broken car.

Lemon Law in 3 Easy Steps

  1. The Lemon Law applies to any vehicle that is within the new vehicle warranty. This includes the original purchaser of the new vehicle along with anyone that follows. In other words, the Lemon Law applies to used car purchases as long as car is still within warranty!
  2. The manufacturer or dealer cannot fix the car within a “reasonable” number of repair attempts. What is a “reasonable” number? That’s a something that we can help you with. It could be as little as one-to-two attempts.
  3. If the defect cannot be fixed, the manufacturer must replace the vehicle or reimburse the buyer for its purchase price. The choice is actually up to you, the consumer!

Yes! As long as the vehicle comes with a new car warranty, the Lemon Law applies to purchased, financed, or leased vehicles.

Do I have to have purchased the car in California?

Yes, to qualify for relief under the Lemon Law, your car must have been purchased new in the State of California.

Does the Lemon Law apply to used cars?

Yes! As long as you are still within the new vehicle warranty period, you may qualify for help under the Lemon Law.

How long does a Lemon Law lawsuit take to finish?

A typical Lemon Law lawsuit in Sacramento will take around six months from start to finish. We fight hard for our clients to make sure that they get all of the benefits to which they are entitled under the Song-Beverly act. You cannot rush a good lawsuit.

The manufacturer is offering me arbitration. Is that a good idea?

What type of defects apply?

You might be surprised! California law says that defect eligible for relief under the Lemon Law “substantially impair the use, value or safety” of the vehicle. This is a wide-ranging definition. In fact, there isn’t a specific list of defects that qualify. Don’t guess! Contact us and we can quickly evaluate your case.

What type of car defects do not apply for the Lemon Law?

We evaluate each car defect on a case-by-case basis. But generally, smaller issues that do not affect the use, value or safety of a car will not qualify. Think of minor squeaks or rattles, very minor paint defects, etc.

My car has been in the shop for more than 30 days. Do I qualify for the Lemon Law?

It sure sounds like it! Vehicles that are in the shop for 30 or more days in a one year period will have a very strong Lemon Law case. Contact us so that we can discuss the specifics of your situation.

I don’t have money to hire a Lemon Law attorney. How can I get help?
